Chapter V – Roads, sandpits and forest infrastructures
Division I – Scope

Section 62

The provisions of this Chapter apply to forests roads over all the territory referred to in section 1.

However, they do not apply to roads under the management of the Minister responsible for the Act respecting roads This link opens a new window (chapter V-9) that are classified as autoroutes or national roads, regional roads or collector roads, except the provisions of Division V regarding sandpits comprised in sections 118 to 123

  • To clarify the scope of the Regulation respecting the sustainable development of forests in the domain of the State

Explanations

The provisions of Chapter V apply to all forest roads and mining roads located in the forest area in the domain of the State that extends to the northern limit of the forest tundra zone. This forest area is shown on the map of vegetation zones and bioclimatic domains in Québec This link opens a new window(in French only) .

However, the provisions of Divisions I to IV and VI of Chapter V do not apply to roads under the management of the Minister responsible for the Act respecting roads This link opens a new window (chapter V-9) that are classified as autoroutes or national roads, regional roads or collector roads as shown on Québec’s road network classification map This link opens a new window . Only the provisions of the Regulation respecting the sustainable development of forests in the domain of the State, sections 118 to 123 of Division V on sandpits, apply to these roads.

Roads in the forest are authorized under the Sustainable Forest Development Act This link opens a new window , except for mining roads, which are authorized under the Mining Act This link opens a new window .

Section 41 of the Sustainable Forest Development Act This link opens a new window states that a person who intends to carry out work for the construction, improvement or decommissioning of a multi-purpose road must be authorized by the Minister on the conditions determined by the Minister. When granting authorization, the Minister stipulates which forest development activities are authorized and sets the conditions that must be met when performing them. Therefore, although the provisions of this chapter do not apply to roads classified as autoroutes or national roads, regional roads or collector roads that fall under the authority of the Minister responsible for the Act respecting roads This link opens a new window (chapter V-9) – except for the provisions of Division V regarding sandpits –construction, improvement and decommissioning work carried out on these roads must be authorized by the Minister responsible for the Sustainable Forest Development Act This link opens a new window .
