§1. General

Section 87

The construction or improvement of a bridge or culvert to cross a lake is prohibited, except if it is authorized as part of an activity or a project for which a certificate of authorization was issued following a decision of the authority concerned made under section 31.5, 164 or 201 of the Environment Quality Act This link opens a new window (chapter Q-2).

When a certificate of authorization has been issued under the Environment Quality Act This link opens a new window for work intended to build or improve a bridge or culvert to cross a lake, the work must also be authorized by the Minister responsible for the Sustainable Forest Development Act This link opens a new window . The Minister specifies which forest development activities are authorized and sets the conditions to be met when they are carried out.

This Regulation does not apply to a holder of a management permit issued for a wildlife, recreational or agricultural development project who lays out a snowmobile trail.

Explanations

A person holding a forestry permit issued for wildlife, recreational or agricultural development work may create a snowmobile trail to cross a lake. The forestry permit specifies which forest development activities are authorized (e.g. creation of an ice bridge) and sets the conditions to be met when they are carried out.

Additional information

The Sustainable Forest Development Act This link opens a new window states that a forestry permit is required to carry out certain forest development activities in forests in the domain of the State (section 73). The Act allows the Minister to issue a permit authorizing the holder to carry out the forest development activities specified on the permit, on the conditions determined by the Minister (section 74).
