Sections 89 and 90 do not apply if the work referred to in those sections are authorized as part of an activity or a project for which a certificate of authorization was issued following a decision of the authority concerned made under section 31.5, 164 or 201 of the Environment Quality Act This link opens a new window  (chapter Q-2).

  • To allow certain forest development activities in or near a particular place

Sections 89 and 90 cover the following work:

  • construction of a bridge or culvert or installation of a removable structure in a spawning ground or within the first 100 metres upstream of a spawning ground indicated in the numeric information layers used for forest planning;
  • construction, improvement or repair of a bridge or culvert or installation of a removable structure in a salmonid watercourse.

The Minister specifies which forest development activities are authorized and sets the conditions to be met when they are carried out.
